This Privacy Policy ("Policy") describes how Kapiva INC ("Kapiva Men," "we," "us", or “our”) collect, use, share and otherwise process personal information in connection with our websites, applications, and other online platforms which link to or display this Policy or personal information we collect in person, by phone or other offline methods (collectively, the “Platform”). This Policy is not, however, a contract and does not create any legal rights or obligations.
When we use the term “personal information” in this Policy, we mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you. It does not include aggregated, de-identified or anonymized information that is maintained in a form that is not reasonably capable of being associated with or linked to you.
TYPES OF PERSONAL INFORMATION WE COLLECT
Contact Information. We may collect your name, mailing address, telephone number and email address. We may also collect your mobile phone number.
Payment Information. We may collect your credit card number, related security codes, and billing address.
Shopping History. We may collect personal information about the items you viewed, added to your cart, purchased, product concerns or returned.
Information You Post. We may collect personal information you post in a public space on our Platform, such as a ratings and reviews feature.
Social Media Information. We may collect personal information you post on our social media pages. We may also collect your social media profile information and personal information posted on your page.
Information You Submit. We may collect personal information when you send us a message through the “Contact Us” page, raise a customer service issue, interact with an event page or similar features we make available on our Platform. We may also collect personal information when you enter a promotion, survey, review or quiz. This may include photos, videos and other user-generated content that you submit. When applicable, we may have additional disclosures about these services or features that we make available to you before you interact with these tools and ask for permission to collect the information that will be collected in that service or feature.
Demographic Information. We may collect your birthdate, age, gender, ethnicity and zip code. We may also collect personal information relating to your hobbies, eating habits, interests, pet information, family statistics, and shopping behavior.
Device, Identifier & Network Information. We may collect the type of device you use to access our Platform. For example, we may also collect your device identifier or other online identifiers associated with you, such as your Universal ID, social media ID or may add in an identifier when you visit our Platform, geolocation, hardware model, network related information, IP address or operating system.
Location Information. We may collect precise location information from your device. This may include information about your exact location when you use our Platform or may include information that allows us to approximate your location. We may also collect this information in the background when our mobile applications are not in use. For more information about your options related to the collection of your location information, see the “Choices Regarding Your Information” section below.
Log, Behavior and Analytics Data. If you use our website, we may collect information about the browser you are using. We may look at what site you came from, or what site you visit when you leave us. If you use our app, we may look at how often you use the app and where you downloaded it. We may collect information using anonymized session recording that includes how you interact with the website, mouse or touch movements, scrolls, mouse clicks, screen taps or zoom data, and time of engagement. In addition to session replay, we may use heat mapping, keystrokes, or other similar methods to better understand your customer experience on our site.
Health-Related Information. If you choose to have a medical consultation or take our tests or surveys, or use certain features of the Platform, we may receive from you directly certain health related information to better serve you, such as general health history, other prescriptions or supplements that you may use, dietary habits, sleep habits, and health and wellness habits.
You may provide us with information about your personal and household preferences in response to website interactions.
HOW WE COLLECT YOUR PERSONAL INFORMATION

We may also collect personal information about you over time and across different websites, apps and devices when you use our Platform, using tracking technologies such as cookies, beacons, pixels, flash objects, APIs and mobile software development kits (SDKs) and we may use third party services to collect this personal information when you use our Platform.

- Our Affiliates. We may receive personal information from affiliated companies and partners when permitted by law.
- From Third Parties. We may receive personal information about you from other sources. For example, this may include receiving personal information from:
- Our business partners, including marketing partners, medical professionals, third-party diagnostic/laboratory providers, analytics vendors, and companies that co-sponsor our promotions.

- Social media sites, including without limitation, Facebook, Twitter, Threads, YouTube, Pinterest, Snapchat, TikTok and Instagram. The information we receive from these social media sites is dependent upon the social media site’s policies and your settings on that site.
- Third party sites, including those that allow you to integrate your third-party account with your Kapiva Men account.
- Family, friends and others who provide your personal information to us because they think you may be interested in our products and services or they want to share a product or service with you.
- Companies that provide personal information to supplement what we already know about you, including data analytics firms and data aggregators. Certain third parties might link your name or email address to other information they have collected. That might include past purchases made offline or online. It might also include online usage information.
- Publicly available sources, including social media sites and public databases.
- By Combining Personal Information. For example, we may:

- Combine personal information we collect about you from the different devices you use to access our Platform.

- For Internal Business Purposes. For example, to provide and improve our Platform, for quality control, and investigations. We may use aggregate and deidentified information including session replay to understand how to provide better products to you, improve our products and solutions, improve our advertising and marketing and to other related business purposes:

- On Our Platform. For example, we may display personal information you post on our Ratings & Reviews feature. We may also display personal information you submit in connection with a promotion.

For example, this may include merchandise providers, payment processors, fraud and security solution providers, subscription services, shipping services, logistics services, customer service providers, cause marketing partners, technology providers, loyalty providers, advertising agencies, marketing and email vendors.
- With Our Business Partners. This may include a third party that co-sponsors a contest or promotion. We may also share personal information with data aggregators, advertisers, media buying agencies, advertising networks and advertising service providers, data analytics providers and business partners who help us offer our products and services.

Our Platform is intended for adults. We do not knowingly collect or solicit any information from anyone under the age of 13 through our Platform. In the event that we learn that we have inadvertently collected personal information from a child under age 13, we will delete that information as quickly as possible. CHOICES REGARDING YOUR PERSONAL INFORMATION
Marketing Communications:
At any time, you can opt out of receiving our marketing communications, including promotional emails and text messages. Note that you will still receive non-marketing or transactional messages from us, including messages about your account and responses to your inquiries. Mobile Application and Location-Based Services:
You may control our collection and use of location-based information through our mobile applications by adjusting the settings on your mobile device. If you withdraw permission for mobile applications to access precise location data, we may continue to approximate your location based on information like your IP address.
You may completely opt out of all location-based information collection by us if you uninstall all of our mobile apps from your devices.
ONLINE ADVERTISING AND THIRD-PARTY TRACKING
Cookies & Other Tracking Technologies:
We automatically collect certain types of personal information about your usage or device when you visit or interact with our Platform, read our emails, click on our advertisements, or otherwise engage with us. We typically collect this information through use cookies (a small text file sent from a website and stored on your device), web beacons or pixels and similar tracking technologies, and we may utilize third party services to collect this information. For example, some of these tracking technologies are required to enable the core site functions to ensure the Platform is secure and to manage our Platform. These cookies for site navigation, ensuring our online forms work, enabling you to log in are essential to our site and cannot be turned off. Other advertising and analytics tracking technologies may collect information about your device and its software, such as your IP address, browser type, device type, date and time stamp, unique device ID, and about the way you engage with our Platform, for example, the site from which you came and the site to which you are going when you leave our website, the pages you visit, how frequently you access our Platform, whether you open emails or click the links contained in emails, whether you access the Platform from multiple devices, the products you view and click on and purchase, the advertisements that you viewed and allow us to measure our advertising.
We use this information collected through tracking technologies to provide custom, personalized content and information, including targeted content and advertising, recognize you across multiple devices, monitor aggregate usage metrics such as total number of visitors, traffic, usage, and demographic patterns of our visitors, and otherwise enhance our Platform and your user experience.

If you block cookies, certain features on our Platform may not work. Depending on your mobile device and operating system, you may not be able to delete or block all cookies and you may not be able to block non-cookie technologies (such as flash cookies) and these browser settings that block cookies may have no effect on such techniques. Interest-Based Advertising:
We engage in interest-based advertising to deliver online advertising that may be more relevant to your interests. We permit third party online advertising networks, social media companies, and other third party services to collect information about your use of our websites, including shopping behavior and purchase behavior, and Platform over time so that they may play or display ads on our Platform, on other websites, apps, or services you may use, and on other devices you may use. Typically, though not always, the information used for interest-based advertising is collected through cookies or similar tracking technologies. We share a common account identifier (such as an email address or user ID) or hashed data with our third party advertising partners to help identify you across devices or serve you ads on social media or other sites you may use. We and our third party partners use this information to make the advertisements you see online more relevant to your interests, as well as to provide advertising-related services such as reporting, attribution, analytics, and market research.

Please note, however, that some advertising opt-outs may not be effective unless your browser is set to accept cookies. Google Analytics and Advertising:
We use Google Analytics to better understand how our users interact with our Platform and such data is shared with Google. We may also utilize certain forms of display advertising and other advanced features through Google Analytics, such as Remarketing with Google Analytics, Marketing 360, Google Display Network Impression Reporting, the DoubleClick Campaign Manager Integration, and Google Analytics Demographics and Interest Reporting. These features enable us to use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the Doubleclick advertising cookie) or other third party cookies together to inform, optimize, and display ads based on your past visits to the Service. Our Do Not Track Policy:
Some browsers have “do not track” features that allow you to tell a website not to track you. These features are not all uniform. While we continue to evaluate this evolving technology, we do not currently respond to those signals. However, you can opt-out of such tracking directly on the Platform by following the steps noted in the Interest-Based Advertising section above. STATE-SPECIFIC DISCLOSURES

Chapter 603A of the Nevada Revised Statutes permits a Nevada resident to opt out of future sales of certain covered information that a website operator has collected or will collect about the resident. The Internet is not 100% secure. Like all businesses, we cannot guarantee the security of the personal information you provide to us via the Platform. We have, however, taken reasonable security measures designed to reduce the risk that the personal information you provide us will be subject to loss, misuse, unauthorized access, disclosure, alteration or destruction. We encourage you to use caution when using the Internet. A user id and a password are needed to access certain areas of the Platform. It is your responsibility to protect your username and password.
STORAGE OF INFORMATION
Our Platform is directed only to U.S. consumers for products and services of Kapiva Men in the United States. Our Platform is not directed to consumers outside of the U.S. Personal Information we maintain may be stored in or outside of the United States. If you live outside of the United States, you understand and agree that we may transfer your personal information to the United States. Our Platform is intended for use in the United States and is subject to the laws of the United States, which may not provide the same level of protections as those in your own country.
LINKS TO THIRD-PARTY SERVICES
Our Platform may contain links to other third-party sites, plug-ins, applications or other online services. If you click on a link to a third-party site or other online service, you will be taken to a site or other online service we do not control and that is not governed by this Policy. HOW TO EXERCISE YOUR PRIVACY RIGHTS
To Exercise Your Rights to Know, Access / Data Portability, Correct, or Delete

We will need to verify your identity and confirm you are a resident of the Commonwealth of Virginia before processing most requests, which may require us to request additional personal data from you. In order to verify your identity, we will generally require either the successful authentication of your account, or the matching of sufficient information you provide us to the information we maintain about you in our systems. Please provide your name, email address and mailing address in the original request, as well as an explanation of the rights you wish to exercise. We will only use the personal data provided in connection with a Virginia Privacy Rights Request to review and comply with the request. If you do not provide this information, we may not be able to verify or complete your request in all circumstances.
If you wish to submit a verifiable consumer request on behalf of a minor child, we will also need sufficient information to verify that the individual is the person about whom we collected personal data and that you are authorized to submit the request on their behalf.
In certain circumstances, we may decline a request to exercise the rights described above. If your request is denied, we will provide an explanation for the denial and instructions on how you may appeal a denied request. You may appeal a denied request by contacting us at info@kapivamen.com.
To Exercise Your Right to Opt Out of Targeted Advertising, Sales, or Profiling
You do not need to create an account with us to exercise your Right to Opt Out of Targeted Advertising, Sales or Profiling. However, we may ask you to provide additional personal data (including your name, email address and mailing address) so that we can properly identify you in our dataset to facilitate the opt-out request. If you choose not to provide this information, we may only be able to process your request to the extent we are able to identify you in our data systems.
Once you make an opt-out request, you may change your mind and opt back in to personal data sales at any time by contacting us at info@kapivamen.com.

In addition, as is common practice among companies that operate online, we permit third party advertising networks, social media companies and other third party businesses to collect personal data directly from your browser or device through cookies or similar online tracking technologies when you visit or interact with our websites, use our apps or otherwise engage with us. For example, they may collect Internet/Network information, such as a cookie or device ID, browsing history and website usage, geolocation data, commercial information related to your transactions, and inferences generated from your browsing history and interactions with our service as well as other sites and services. These third parties use this information for the purposes of serving ads that are more relevant and targeted, for ad campaign measurement and analytics, and for fraud detection and reporting and may sell or share that information with other businesses for advertising and other purposes. Please see the section entitled “Online Advertising and Third Party Tracking” in our Privacy Policy to learn how you may exercise your choice over this data collection for advertising purposes.
Sensitive Data and Personal Data of Children Under Age 13
We will only process your Sensitive Data in accordance with applicable law, including obtaining your consent prior to processing. We will not process personal data of consumers we know to be less than 13 years of age unless we receive affirmative authorization from the parent or guardian of a child less than 13 years of age. If a parent, guardian or child has provided affirmative authorization, they may opt out of future processing at any time by contacting us at info@kapivamen.com.
NONDISCRIMINATION
We do not discriminate against you in processing your data in accordance with applicable laws or for requesting any of the rights noted above. We are permitted to deny or limit your request in accordance with applicable laws.
